1. Agreement to Terms

By accessing or using Review Monster's services, website, or any applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Review Monster provides automated review generation and reputation management services for businesses. Our platform helps businesses collect, manage, and respond to customer reviews through automated SMS, email, and other communication channels.

3. Account Registration

To use our Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your contact information remains accurate and up-to-date

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Send review requests to individuals who have not been your customers
  • Use the Service to send spam or unsolicited messages
  • Attempt to manipulate or post fake reviews
  • Violate any applicable laws, including TCPA, CAN-SPAM, or GDPR
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to harass, abuse, or harm others

5. Customer Data and Consent

You represent and warrant that:

  • You have obtained proper consent from your customers to contact them via SMS, email, or other channels
  • All customer data you upload to our platform has been collected in compliance with applicable laws
  • You have the right to use and share customer data with our Service
  • You will comply with all opt-out requests promptly

6. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing:

  • You agree to pay all fees associated with your chosen plan
  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Your subscription will auto-renew unless cancelled before the renewal date

7. Free Trial

We may offer a free trial period for new users. At the end of the trial, your account will be automatically charged unless you cancel before the trial ends. We reserve the right to modify or terminate free trials at any time.

8. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not receive a refund for any unused portion of your subscription
  • Your data will be retained for 30 days before deletion unless otherwise requested

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Review Monster and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.

10. Third-Party Services

Our Service may integrate with third-party services (such as CRMs, Google, Facebook, etc.). Your use of these integrations is subject to the terms and conditions of those third parties. We are not responsible for the practices or content of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted or error-free
  • Any specific number of reviews will be generated
  • Your search rankings will improve
  • The Service will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEW MONSTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Review Monster, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Ada County, Idaho.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
